Staff Pick: Supreme Court Practice

The first Monday in October has been the traditional date — since 1917 — of the U.S. Supreme Court beginning its session. Originally holding two sessions, our highest court has commenced its sessions on First Mondays in February, August and December. In 1802, sessions were consolidated and by 1917, the starting date of October was set.

“First Monday in October” — 1981 Political Comedy about the first female U.S. Supreme Court Justice — on film, court’s first Madame Justice is Jill Clayburgh (not Sandra Day O’Connor!!)

In honor of our highest court — my staff pick for the month of October is Supreme Court Practice, now in its 11th edition… and THE standard for any attorney preparing a case before our highest court….

Consider just some of the topics included –

  • Manner in which the Court Determines to Take Jurisdiction
  • Procedure in connection with Petitions for Certiorari
  • Procedure on Appeal
  • Certified Questions
  • Oral Argument
  • Capital Cases
  • Standing, Mootness, & Abatement

For the exact details of Supreme Court Practice, Appendices cover the Rules, Clerk’s Guidelines, Forms, Certificates, Brief on Merits, Statutes & Regs, and Bar Admissions.

And, then there are the Checklists for processing cases — as well as “the back of the book” standards of Table of Cases, Subject Index, and Table of Rules & Laws….
